Terms of Service

1. About these terms

OctaPages (https://octapages.com) is a directory of local businesses in India, operated by Minivet System LLP. Our registered address is Unit No. 12ES4, 12th Floor, East Tower Mani Casadona IT Building, Plot #2 F/4, AA II, F Newtown, Chakpachuria West Bengal 700156, India.

By creating an account or using OctaPages, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the service.

2. Your account

You must be at least 18 years old, or use the service with a parent or guardian's consent. Give accurate details and keep them up to date.

Keep your password private and turn on two-step verification if you manage a business. You're responsible for what happens under your account. Tell us at once if you think someone else has used it.

3. Listing a business

Only list a business you own or are authorised to represent. Everything you publish about it (name, address, phone, hours, prices, photos) must be accurate and yours to publish.

We review new listings and photos before they appear, and we may check changes to live listings. We may decline, correct or remove a listing that breaks these terms or that we can't verify, and we'll tell you why.

Verification badges show what we checked (for example, a business email or documents). They are not an endorsement of the business's services.

4. Reviews and other content

Reviews must describe your own experience with the business. Our Review Policy explains what is allowed and how we moderate. By posting content, you let us show it on OctaPages and in search results, for as long as it stays published.

Businesses may reply to reviews publicly. A business can't remove, hide or reorder reviews, and paying for a sponsored plan never changes that.

5. Enquiries and dealings with businesses

When you send an enquiry, we pass your message and the contact details you give to that business so it can reply. Any deal you then make is between you and the business; we are not a party to it and don't guarantee its services, prices or availability.

6. Business workspaces and plugins

A business can buy plugins (for example, the WhatsApp CRM) from the OctaPages Marketplace, or be given one by our staff. The first plugin creates the business's private workspace at its own address (for example yourbusiness.octapages.com), with a database used by no other business.

What a business puts into its workspace (its customers' contacts, conversations, notes and files) belongs to the business. For that data the business is the Data Fiduciary and OctaPages processes it only on the business's behalf, under our Data Processing Addendum (https://octapages.com/data-processing).

A business that messages its customers must have their consent or another lawful basis, must follow WhatsApp's Business and Commerce policies and the TRAI rules on commercial communication, and must stop messaging anyone who asks it to.

7A. If a reseller manages your business

Some businesses use OctaPages through a service provider, a "reseller", that sets up and supports their workspace, sometimes under its own name and web address. If yours does: the reseller's people appear in your workspace's Team list with a Reseller badge, every time they open your workspace is recorded, and you can switch on an email for each visit, turn on "fully managed" so that you cannot remove them by mistake, or remove them yourself while it is off.

Your data stays yours. A reseller reaches your workspace only as a visible member that you can remove; it has no other way into your customers' contacts, messages or files. You can leave your provider at any time from your workspace: the apps it paid for keep running to the end of the period it paid for, then your business continues directly with OctaPages, and nothing of yours is deleted. If your provider's account is suspended for 30 days or closed, you have 30 days to continue directly or move to another provider, and nothing of yours is deleted in that time.

Your reseller, not OctaPages, decides what you are charged for the apps it sells you, and is paid by you directly; OctaPages never collects those payments. A provider may take over from another only if you agree, and our team then checks the change.

7. Deleting a workspace

Before a workspace is deleted, we take an encrypted backup, read it back and test-restore it; only when that check passes is the workspace deleted. We keep the backup for 30 days (1 month). Until then the business owner can ask us to restore the workspace exactly as it was; after that the backup and the workspace's files are deleted permanently and cannot be recovered.

Only an administrator of OctaPages can download a backup. A business that wants a copy of its own data should ask before the workspace is deleted.

8. What you must not do

You must not use OctaPages to:

• post anything false, misleading, defamatory, obscene, hateful, or unlawful, or anything listed as prohibited in Rule 3(1)(b) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021;
• impersonate a person or business, or write reviews about your own business or a competitor's;
• send messages to people who have not agreed to hear from the business, or buy or share lists of phone numbers;
• send spam, collect other people's data, or copy the directory with bots or scrapers;
• interfere with the service, test its security without our written permission, or upload malware.

9. Paid plans and subscriptions

Plugins are sold as subscriptions. Prices are shown in Indian Rupees on our Pricing page and at checkout; GST is added at the rate that applies and shown before you pay, and every charge gets a GST tax invoice.

Autopay subscriptions renew automatically at the end of each period (monthly or yearly) through a UPI or card mandate you approve with our payment partner, Razorpay, until you cancel. Prepaid plans cover a fixed number of months and do not renew. We never see or store your card number, UPI PIN or bank password.

Businesses may also buy sponsored plans that show a listing more prominently. Sponsored placements are always labelled "Sponsored" and never change ratings, reviews or organic search order.

Cancellations and refunds follow our Refund and Cancellation Policy; how access is delivered is described in our Shipping and Delivery Policy.

10. Our content and trademarks

The OctaPages name, logo, design and software belong to Minivet System LLP. You may not copy them without permission.

11. Disclaimers and liability

Business information comes from the businesses and from our community. We work to keep it accurate but can't guarantee it. The service is provided "as is".

To the extent the law allows, we are not liable for indirect or consequential losses, or for the acts of the businesses listed. Nothing in these terms limits rights you have under the Consumer Protection Act, 2019.

12. Suspension and closing your account

We may suspend or remove accounts, listings or content that break these terms or the law, and we'll give the reason unless the law prevents it. You can delete your account at any time from Settings → Privacy.

13. Complaints and the Grievance Officer

You can report any content from its page, or write to our Grievance Officer through https://octapages.com/grievance. We acknowledge complaints within 24 hours and resolve them within 15 days, as the IT Rules, 2021 require.

14. Governing law

These terms are governed by the laws of India. Disputes are subject to the jurisdiction of the courts at Kolkata.

15. Changes to these terms

We'll post any change on this page with a new date, and email account holders about important changes before they take effect. Continuing to use OctaPages after a change means you accept it.
